Conveniently because as an outcome of recent elections, Muslim Rightist Congress doesn't need to sleep with its Anti-Hindu Leftists partners in order to hog the power. Maoist Terrorist attack (gun firing attack) near CISF camp, Panchpatmali Hill, Damanjodi (approximately 350 km from Bhubaneswar), Koraput district, Odisha (misnomer: Orissa) on 4/12/2009 at 2115 hrs


The attack happened near a state-owned National Aluminium Company Limited (Nalco)'s open-pit bauxite mine. No word from the Government of India about what they have done to curb this cancer of terror. Dhimmi Sardar has not lost his sleep yet. Looks like there is no value of these brave and selfless men & women of CISF for these politicians who are safe and sound under their Rs 180 Crores security cover provided by the very same CISF/CRPF courtesy of exploited Tax Payers. This is the 47th terrorist attack in 5 years.

Maoists attack CISF camp in Orissa
"The rebels surrounded the CISF camp at Panchpatmali Hill at about 9.15 pm. An exchange of fire between CISF personnel and the rebels is on," District Superintendent of Police Deepak Kumar told IANS over telephone.

Terrorist attack (multiple powerful Bomb blasts) near Nilalong, Assam on 4/12/2009 at 2115 hrs

Just 6 days after the last terrorist attack in Gauhati, Assam on 4/6/2009, and the ones before it like terrorist attack in Guwahati, Assam on 3/31/2009, terrorist attack in Tezpur, Assam on 3/25/2009 and few months after a series of brutal attacks in Gauhati, Assam on 12/1/2008, 1/1/2009 and 1/10/2009, another series of powerful bomb blasts ripped apart a railway track, almost missing it's possible target Kolkata-Dibrugarh Kamrup Express train. It however, derailed the security patrolling engine preceding the train. The first of the two explosions took place around 2115 hrs IST near Nilalong, close to Diphu, the headquarters of Karbi Anglong district, about 320 km east of Assam's main city of Gauhati (misnomer: Guwahati). The attack was done by Karbi Longri National Liberation Front (KLNLF) terrorists who also fired from both sides at the engine.

Blast targets Kamrup Express in Assam, no casualty
Official sources said an improvised explosive device (IED) was triggered on the track at Kalahandle between Doldoli and Diphu railway stations at around 9.15pm.

The engine in which RPF personnel was checking the railway line for bombs before arrival of the Kamrup Express, jumped the tracks and fell on its side after the blast.

Diphu will go to polls on April 16 when first phase of Lok Sabha elections will be held in Assam. The militants called a 48-hour bandh from April 15.
This is 46th major terrorist attack in five years but what did Dhimmi Sardar do? Nope you guessed it wrong this time. He didn't say his parroted statement this time because he has not even cared to release any statement this time. Can't believe this "Back Door PM", as media calls him, has been a Rajya Sabha MP from Assam for past 18 years. It's clear that there is no proper government in Assam, a state which is also massively infiltrated by illegal Muslim Bangladeshis, to take care of law and order situation because it seems that it's the terrorists who are openly calling the shots there.

Just 6 days after the last terrorist attack in Gauhati, Assam on 3/31/2009 and 12 days after last terrorist attack in Tezpur, Assam on 3/25/2009 and few months after a series of brutal attacks in Gauhati, Assam on 12/1/2008, 1/1/2009 and 1/10/2009, another series of powerful bomb blasts ripped apart Gauhati, Assam at 1340 hrs and left at least nine people dead and more than 60 people injured.

This is 45th major terrorist attack in five years but what did Dhimmi Sardar do? Yeah, you guessed it right! Condemn it with his parroted statement and that's it, his responsibility is over. So, God Forbid just wait for the next one. Even the shocking and sickening scenes of BODO terrorist training camp video has not been enough to bring this derelict government out of denial of internal insecurity.

Terror blasts ahead of PM's visit rock Assam, kill 9
The finger of suspicion pointed to the northeast's most active terrorist outfit, the United Liberation Front Of Asom (Ulfa), which is to mark its 30th 'Raising Day' on Tuesday. In the past, Ulfa terrorists have triggered blasts in the state to observe the day and also planted bombs just ahead of VVIP visits, the deadliest being serial blasts in January, just ahead of Chidamabaram's first visit to Guwahati as home minister.

Monday's deadliest blast was triggered at a busy bus stop at Maligaon on the outskirts of Guwahati around 1.40pm and killed eight people, including a 10-year-old boy. More than 50 people were injured there. The Maligaon police station and the headquarters of the Northeast Frontier Railway are a stone's throw from the site.

According to a police officer scanning the site minutes after the blast, the explosion at Maligaon was caused by an improvised explosive device (IED) planted either on a bicycle or a motorcycle. People waiting at the bus stop were the first to be hit.

The blast was so powerful that several cars and motorcycles parked nearby caught fire. The flames soon spread to neighbouring houses. Many people jumped out of their windows in panic to escape the fire and smoke and injured themselves.

"The Maligaon blast may have been carried out by one of Ulfa's 109th battalion members who have recently sneaked into the city. We came to know about a 27th battalion Ulfa cadre named Deepak who had supposedly hired a man called Sagar Topno to carry out the blast in Sonitpur district," a source said.

Forensic experts who visited the blast site at Maligaon said bicycle ball-bearings were packed into the bomb as shrapnel.
109th battalion?! How many battalions do they have? No wonder that BODO terrorist training camp video looks nothing short of an army being trained to rage a full fledged war on Bharat. Seriously, the gravity of situation due to nonexistent internal security of Bharat disgusts me.

These terrorists did deadliest bomb blasts to show their power and ease everytime just days before Shivraj Patil, Chidambaram, Pranab Mukherjee and Manmohan Singh arrived in Assam. Every time it was probably done to directly challenge Government of India but it has no takers because the Congress led UPA has no b*lls and will to fight. Government lives in denial while the citizens are massacred day in and day out.

Terrorist attack (powerful Bomb blast) in Gauhati (misnomer: Guwahati) on 3/31/2009 at 1800 hrs
This is the 44th major terrorist attack in five years under derelict Congress led UPA government. It is sad to see that none of Indian media is taking this attack seriously and not even featuring it to demand an explanation from the Congress Government. It's like Assam is not even a part of Bharat (misnomer: India) for all they care.

One killed, 16 injured in Assam blast
At least one person was killed and 16 others injured when a bomb planted by suspected ULFA militants exploded near a hotel in Lalganesh area in Guwahati, minutes before External Affairs Minister Pranab Mukerjee was scheduled to arrive there to address
an election meeting.

The bomb exploded near Shankar hotel in Jyotikuchi Road at around 6 p.m. Killing a labourer on the spot and injuring 16 others.

ULFA Terrorist attack (hand grenade bomb blasts) at Lakhsmi Mandir area, Sonitpur district, Tezpur town, Assam on 3/25/2009 at 1850 hrs
Four people including CRPF army men were injured when a group of ULFA terrorists hurled the grenade in the busy Lakhsmi Mandir area when people were shopping in headquarter town of Sonitpur district at 6.50 PM. This is the 43rd major terrorist attack in five years under derelict Congress led UPA government. It is sad to see that none of Indian media is taking this attack seriously and not even featuring it to demand an explanation from the Congress Government. If issuing a cheque to a potential voter is an alleged violation of the model code of conduct, what about a rain cheque?

That’s what happened at an election meeting of CPM’s Dum Dum Lok Sabha candidate (and sitting MP) Amitava Nandi last week, leaving behind an angry, distraught mother.

Bus employee Gopal Rajbanshi, a member of CITU, the CPM’s trade union wing, was killed in 2007 in an alleged gang-war by members of a rival CITU faction. Two years and no arrests later, the CPM suddenly remembered his mother Krishna Rajbanshi on March 13 and decided to call her onto the stage at an election meeting attended by Nandi. There, in full public view, she was handed an “envelope” presented to her as a “cheque for Rs 25,000.”

This was brought to the notice of state chief electoral officer Debasish Sen who said he ordered an inquiry and has sent his report to the EC.

When 'The Indian Express' met the mother, she was furious. “The cheque-distribution ceremony was a fraud,” she said. “There was no cheque, no cash. When I came home and opened the envelope, there was only a letter.”

14th Lok Sabha ends, the worst in history

Few MPs in House in last day of 14th Lok Sabha
It was curtains for the 14th Lok Sabha on Thursday which will go down in history as a House full of unprecedented acrimony, controversies and dubious distinctions like cash-for-vote scam and disqualification of 11 members.

The Lok Sabha was adjourned sine die by Speaker Somnath Chatterjee who recorded his dismay at the huge 24 per cent of time lost due to disruptions and "politics of intense confrontation".

The House enacted 258 legislations, including the landmark ones like Right to Information, National Rural Employment Guarantee Act, Protection for Women from Domestic Violence Act, Disaster Management Act and National Investigation Agency Act.

At the same time, the 14th Lok Sabha witnessed the unprecedented lows like display of wads of currency notes during the Confidence Vote in July last year, with three BJP members alleging that they were offered money to save the Manmohan Singh government.

The 14th Lok Sabha also witnessed 11 members being disqualified for various acts of misconduct, including corruption. Some other members were disqualified under anti-defection law for cross-voting.
Oooooh, the house enacted landmark legislations, let's have a look:

Right to Information: Nice step but only on books. Moment after it's enactment Congress led UPA government handicapped it by appointing bureaucrats as CIC, PMO cut it's wings by removing important parts of it for eg. by withdrawing ability to reveal all important file notings, denying the information by hiding behind the official's secrets act and most recently by refusing to reveal any information by Judges, PMO, Ministers and bureaucrats.

National Rural Employment Guarantee Act: Zealously marketed as Antonia Maino aka Sonia Gandhi's pet project (mind you not Prime Minister but Super PM), this is just another farce Band Aid act to fool the innocent poor farmers et al. It's an act with most under used funds and ironically it's best implemented in non-Congress non-Left BJP ruled states.

Protection for Women from Domestic Violence Act: Bombastic, Female chauvinist and selective claimer of "Talibanization is happening" Ms. Renuka Chaudhury of Congress brought this one-sided not-so-men-friendly-due-to-loop-holes act which did nothing but to legitimize another one of blindly copied immoral western concept of "live-in" relationships. In addition to create more complex societies because now a person has to pay maintenance to any woman who claims it by accusing domestic violence, in other words living a polygamist life despite being a single, this may cause an increase in the false cases which will waste all important judiciary time and taxpayers money. It's funny that so much was the side effect of this act, most probably coincidentally, that Yash Raj Films and Karan Johar have been only coming out with movies on the topic of live-in relationships (like Salam Namaste) and infidelity (some K movie.. Kabhi Alvida something I guess).

Disaster Management Act: Oh, how well Bharat managed disasters like floods in Bihar, Islamic terrorist attack in Mumbai on 26/11 when NSG took more than 14 hours to reach the ground zero and some of the Indian media possibly compromised the operation due to their unethical journalistic practices or recently during false hijack by a deranged man when officials had no idea what to do with the isolated plane and it took more than 2 hours to open the door and passengers were talking to media through relatives.

National Investigation Agency Act: Here we come to the NIAaaaa (yawning) agency. You may not be concerned but bring us (Congress led UPA with Left support) to power and we will remove POTA, not build infrastructure, not build schools, not build colleges, not stop taxing any Mandirs, not stop breaking Ancient Hindu heritages, not build an indigenous weapons system with strong armed forces but bring us to power and we will remove POTA. What was the f**cking point of removing POTA when you had to create this half-baked bureaucratic agency half-heartedly not immuned from political influence. Why did this derelict government waited for over 42 major terrorist and naxal attacks to happen only to bring this handicapped version of act back without any proper Parliament scrutiny? Why was the fashionable Shivraj Patil, the worst Home Minister who was busy changing his clothes not sacked earlier? Why is he not being tried for criminal negligence when there was credible information about the recent Islamic terrorist attacks in Mumbai as back as one year before the unfortunate day?

The report may have conveniently forgotten but we have not forgotten this following bill:

Office of Profit Bill: A tight slap on the face of constitution's founding fathers and the people of the so-called republic when the whole constitution is modified just to save and for the profit of one person who was married in the dynasty which conveniently happens to have the same last name as one of the freedom fighter of Bharat. The shameful bill has the word profit in it and it is nothing but black spot on the Khichdi constitution of Bharat. Unfortunately the meaning of Republic stands changed from "of the people by the people for the people that is not led by a hereditary monarch" to "of a person by a person for the person led by a particular dynastic monarchy in disguise of democracy".

TOI you are right. These are landmark legislations. They serve as exemplary example of what not to do for future generation of Bharat, if they happen to be Hindu and nationalist that is, and they will laugh over dinner of what fool their ancestors were to not learn from their ancestor Dhritrashtr's mistakes.

    • CBI acting at Centre's behest in Mulayam case: SC

    • SC pulls up CBI for dillydallying in Mulayam assets case
      The Supreme Court severely criticized the Central Bureau of Investigation (CBI) on Tuesday for seeking to withdraw its earlier decision to proceed against former UP chief minister Mulayam Singh Yadav and his relatives in the case relating to their alleged disproportionate assets.

      The court rebuked the CBI for approaching the central government for advice on the matter and asked the investigating agency's counsel, additional solicitor general Mohan Parasaran: "Since when has the CBI started taking advice from the government? Why didn't you come to the court for clarifications?"

      "You (CBI) are acting at the behest of central government and the law ministry. You are not acting on your own," said a Bench comprising Justice Altmas Kabir and Justice Cyriac Joseph, PTI reported.

      The court's observations came Parasaran said that the opinion of the law ministry was sought to withdraw an application filed by the CBI in which it had sought to file a report on inquiry before the apex court and not to the Centre.

      "You realise what you are saying. It is very unusual. It is because the central government gave opinion you filed the interim application (for withdrawal of the earlier application seeking to file the report on inquiry to the apex court)," the Bench said.

      "Why you filed the interim application on the opinion of the central government? It is incomprehensible," the Bench said.

    • Unbecoming Unparliamentary fracas in UP assembly over engineer's murder
      The budget session of the Uttar Pradesh assembly got off to a raucous start on Tuesday with opposition Samajwadi Party legislators Ruckus in UP assembly throwing paper missiles and hurling mikes while Governor T V Rajeswar watched helplessly from his podium with his marshals trying to fend the blows.

      The Samajwadi Party was protesting the Dec 24 murder of Public Works Department (PWD) engineer Manoj Kumar Gupta in Auraiya district, 150 km from here, allegedly at the behest of a ruling Bahujan Samaj Party (BSP) legislator.

      They were joined by members of other parties, including the Congress and the Rashtriya Lok Dal, who shouted slogans and displayed banners outside the assembly.

      The legislators held aloft black pieces of cloth and threw files in protest against the murder while alleging that the law and order situation in the state was in disarray.
      Look who is talking about the law and order situation! Those who destroy national property in assembly itself.

  12. LeT man accuses FBI agent of 'sexual assault'
    Lashkar-e-Taiba operative Faheem Ansari's lawyer has alleged before a magistrate that Ansari was "sexually harassed" by "a woman agent" from the Federal Bureau of Investigation while he was in custody of Mumbai Police’s Crime Branch. Ansari is an accused in the 26/11 attack.

    Advocate Ejaz Naqvi moved an application before the magistrate at Esplanade Court on Monday, demanding Ansari be taken for a "medical examination". He told reporters Ansari was made to "watch certain videos". The court issued a notice to the Crime Branch and asked it to file a reply by February 26.
    Now this is the joke of the day. A terrorist sexually assaulted by an American Woman FBI agent in Bharat. Sure, so believable. Faheen Ansari, we will believe you when Pigs will fly. Why don't you ask then? Also, since when does "made to watch certain videos" comes under the area of a sexual assault. If its true, then why didn't the courts, government, and media do anything when Sadhvi Pragya Singh Thakur complained that she was sexually molested and made to watch pornographic videos by ATS. Oh we forgot, may be because she is not a Muslim who have the first right India as per puppet Manmohan Singh. Also because Hindus don't have any rights in Bharat and if their Temples, if any, are openly vandalized by the state then she is just a follower of Hinduism. Why should she be left untouched?

    Setting up more courts so that people have easier access to justice may be a good idea but it would be meaningless unless 80-85% of
    the population had at least high school level education, the Supreme Court said on Friday.

    A Bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam said establishing more courts alone would not solve the problem and cited a PIL on the death of over 4,000 tribals in road accidents in Sonebhadra district of UP where not a single victim's family got compensation.

    "The Motor Accident Claims Tribunals are there but the illiterate tribals had no knowledge of how to exercise their legal rights for compensation, being ignorant about approaching the tribunals," the Bench said responding to the suggestions on judicial reforms by counsel Prashant Bhushan on a PIL.

    To tackle the pendency of nearly 2.5 crore cases, there was an urgent need for an additional 10,000 courts, the CJI said. "But, establishing these courts alone will not give the desired result. To approach these courts for grievance redressal, there has to be awareness, which will come only when there is a rise in the education level among people," he said.

    Ramani Krishnan, who is the 11th accused in the chargesheet filed by crime branch, told a TV channel that the sons of at least two senior party leaders were linked to the scam. A section of the media pointed at the finger at Binish Kodiyeri, son of state home and tourism minister Kodiyeri Balakrishnan.

    Ramani is also learnt to have filed a complaint against Sabarinath and some others accusing the former of trying to buy luxury vehicles and leasing them out to the tourism department using his political connections.

    Disgraced Satyam boss B Ramalinga Raju may not be able to access his wardrobe full of designer suits and shoes, but from Saturday his stay at Hyderabad’s Chanchalguda prison will get a little better.

    Raju and his brother, Rama Raju, have been living the life of ordinary inmates since their arrest on January 9 — sleeping on cold mattresses on the ground, eating watery daal and rice and sharing toilets with other prisoners.

    Granted special class prisoner status on Friday, the brothers will now get cots, pillows, mattresses, sheets, mosquito nets, a separate kitchen and toilet, jail sources said.

    The facilities go beyond bare necessities. ‘‘They can get newspapers and can smoke cigarettes or cigars if they wish to. They can also eat meat and fish everyday provided it is brought by their family members,’’ the source said.

    Apart from separate cots, pillows, mattresses, toilet, kitchen, there are other privileges that the Rajus can ask for. ‘‘Like if they ask for a colour TV, it is the duty of the state government to provide it,’’ one official said. The only facility they are denied is access to a telephone.

    A Hyderabad lower court granted special class prisoner status to the Rajus few days ago. However, the order asked the Hyderabad collector, under whose jurisdiction Chanchalguda falls, to certify that the Rajus were used to a high lifestyle and should be accorded the same while in jail.
    I, I don't have words. So if someone is used to high lifestyle and has houses in 64 countries irrespective of what disgraceful unethical criminal ways in which they accumulated so much money, they will be extended such high lifestyle in prison also. With all due respect, Courts should throw such people in prison with dreaded criminals so that they will get remorse for their crimes instead of letting them stay in a private cell fully furnished and equipped like some five star hotel room. That would have set a good precedence rather than discriminating amongst even criminals on the basis of their financial status. This is the new caste/class based discrimination of 21st century where people are segregated in airlines, restaurants, discos, hotels, even prison on the basis of their lifestyle and financial status.

Election Commission: Sonia & Left in the dock

Sonia Gandhi and her former Left comrades are in the dock in the current turmoil in the Election Commission, although it is true that the crisis began with BJP’s petition to President APJ Abdul Kalam seeking removal of Election Commissioner Navin Chawla on grounds of his pro-Congress affiliations.

As if to underline the extent to which constitutional bodies have been politicized by the Congress Party, the Assam State Election Commissioner Chandra Kanta Sarma resigned on 31 January 2009, and is now seeking a Congress ticket from Mangaldoi parliamentary constituency! Mr. Sarma was admitted to the Congress on 1 February, and submitted his request for the party ticket the same day.

Former Chief Election Commissioner Manohar Singh Gill is currently serving as a Minister of State in the UPA Government. Now, with a serving state Election Commissioner resigning to contest the forthcoming Lok Sabha polls, the Communist Party of India (Marxist), which has called for a bar on former EC Members taking political posts or contesting elections, will have to take a call.

The CPM withdrew support from the UPA on the issue of the Indo-US nuclear deal last year, but has extended support to Mr. Navin Chawla and joined hands with the Congress in casting aspersions against Chief Election Commissioner N. Gopalaswami for recommending the removal of Mr. Chawla. This support is untenable and can be understood only when one perceives that like the Maoist regime in Nepal, the CPM is dominated by minorities, and this often gives the party a pronounced anti-Hindu edge.

The minority – or at least the non-Hindu – angle has played up at critical moments in national politics, and this may well be the time to ponder if there ought to be a statutory limit on the number of key constitutional posts that members of minority groups can hold at a given moment. This idea needs nation-wide debate, as the Hindu majority seems to be getting the short end of the stick in every crisis.

The current crisis broke into the public domain immediately after Election Commissioner S.Y. Qureshi (whose religious affiliations are self-evident) declared on an official trip to London that the Lok Sabha elections would be held between 8 April and 15 May 2009. The UPA took instant advantage of the information to sharply reduce the prices of petrol, diesel and cooking gas; more populist announcements are reportedly on the anvil, which Congress is keen to announce before the model code of conduct becomes operative.

As for Mr. Navin Chawla, he owes his position as next CEC-designate to his proximity to the Gandhi family, which began during the notorious Emergency of 1975-77, when Congress president Sonia Gandhi was close to her brother-in-law Sanjay Gandhi, and joined some of his business ventures, as subsequently brought out by a commission of enquiry. While Mr. Chawla’s religious affiliations are not known, he owes much of his fame to authorship of two books on the Albanian nun, Teresa, whose so-called sainthood is subject of much controversy in the West as well as in India!

It is pertinent that in March 2005, just two months before his appointment as Election Commissioner, Mr. Chawla was bestowed the Mazzini Award by the Italian government. Ms. Sonia Gandhi, as is well-known, is an Italian-born Roman Catholic. Her son and Amethi MP, Rahul Gandhi, has studiously refused to answer questions regarding the nature of his citizenship (given the Roman law) and whether he also holds an Italian passport, a situation untenable in Indian law.

While Mr. Chawla’s appointment naturally created misgivings that he had a pro-Congress leaning, it became unacceptable once the media exposed that he had received undue favours from the Ashok Gehlot regime in Rajasthan, and that Congress MPs had made huge donations from MPLAD funds to a private trust owned by him and his wife.

It was in this backdrop that over 200 MPs of the NDA signed a memorandum requesting President Kalam to remove Mr. Chawla from office. Later, BJP leader Jaswant Singh filed a petition in the Supreme Court in May 2006, which it withdrew when CEC Gopalaswami filed an affidavit saying he had the power to remove any Member for substantial reasons. BJP then forwarded its petition to the CEC. The CEC’s power under Article 324(5) was affirmed by the Supreme Court in T.N. Seshan vs. Union of India (1995).

In his letter to President Pratibha Patil citing 12 instances of partisan behaviour by Mr. Chawla, one of the key issues pertains to the Order of the Leopold Award conferred by the Belgium Monarchy upon Ms. Sonia Gandhi. A controversy over the citation led to an opposition demand for disqualification of the Congress president, and Mr. Chawla roped in the Ministry of External Affairs to bail her out.

Sources say that the Commission deliberated for over five months, during which period the PM’s principal secretary T.K.A. Nair visited the Commission to plead that there was no case against Ms. Gandhi and that the PM had already examined the matter. Though the Commission finally decided to issue notice to Ms. Gandhi, Mr. S.Y. Qureshi reportedly changed his mind and felt the notice should not be served. Ms. Gandhi has since replied to the notice, but Mr. Chawla has failed to furnish his comments and hence the Commission has not finalized its views on the matter.

Precisely these stonewalling tricks were deployed by Mr. Chawla in the matter of the CEC’s show-cause notice on the BJP petition. He sought the opinion of the Union Law Ministry, which has now publicly taken the stand that the CEC does not have the authority to take suo motu action on such petitions. Yesterday (2 February), Law Minister Hansraj Bharadwaj went a step ahead and declared Mr. Chawla as CEC-designate (Mr. Gopalaswami retires on 20 April 2009).

Mr. Gopalaswami’s recommendation for removing Mr. Chawla for ‘‘partisanship’’ comes close to the forthcoming Lok Sabha elections because the latter submitted his reply to the charges only on December 10. The CEC then submitted his report to the President on 16 January 2009.

The CEC delayed seeking Mr. Chawla’s explanation for six months, sending the notice only on 21 July 2008, owing to differences with the latter over the timing of the Karnataka elections, which ended in May 2008. On 12 September 2008, Mr. Chawla wrote that he was seeking the Law Ministry’s opinion on whether the CEC had the power to make a suo motu inquiry against an Election Commissioner. After the Karnataka election, Mr. Chawla went on a month’s leave, and this further delayed matters.

Although Mr. Gopalaswami wrote back on 17 September that he had the power to take cognizance of BJP’s petition even without a reference from the government, the Law Ministry on 7 November opined that the CEC could not proceed without a reference from the government. But the CEC persisted and Mr. Chawla finally replied on 10 December 2008. Thereafter, Mr. Gopalaswami sent his report to the President on 12 January 2009. He might have refrained from making the matter public, but for the indiscretion of Mr. Qureshi.

Amongst the instances of Mr. Chawla’s “partisan” behaviour, the CEC has cited his role in deciding the poll dates for Uttar Pradesh, Gujarat and Himachal Pradesh in 2007, besides his unilateral and startling decision to consult the Ministry of External Affairs about the notice to Congress president Sonia Gandhi for accepting a Belgian honour.

The CEC has also raised questions about Mr. Chawla’s role in the BJP’s CD case and the Bhagalpur by-election. When the Commission was discussing dates for the Gujarat election, Mr. Gopalaswami supported the state chief electoral officer’s suggestion for a three-phase poll; Mr. Chawla disagreed. The Home Ministry made arrangements of central paramilitary forces for a three-phase poll.

The three-phase poll was still an internal decision of the EC when a senior Congress leader called the Commission and asked why it could not be a two-phase poll. The CEC reportedly mentioned the unavailability of forces, but the person said the Home Ministry would help. Within hours, Mr. Chawla informed the CEC that more forces would be made available for Gujarat! And within the next few hours, Home Ministry officials called the Commission and offered more forces. Gujarat finally had a two-phase election.

Mr. Chawla also differed on the timing of the Himachal Pradesh polls, and tried to delay finalizing his decision on some pretext or other. He repeated these tactics when the Commission was discussing the schedule for the UP election, and Congress learnt of the dates.

Notwithstanding the desirability of his removal, it is evident from the brazen approach of the Congress and UPA government that Mr. Chawla is not only going to stay for the duration of the Lok Sabha elections, but going to be elevated as Chief Election Commissioner thereafter. Commissioner Qureshi has already proved convenient to the UPA government.

In these circumstances, a parliamentary election conducted by these two officers will lack public confidence and credibility. Hence it would be in the fitness of things if all political parties decide to complete the election process by 20 April 2009, when all three Commissioners are in office. As the current Parliament's term ends in April, this would be appropriate.

As for the BJP – if Mr. L.K. Advani is serious about becoming Prime Minister and not just NDA’s candidate for PM – it should train its guns on the foreign origins of Ms. Sonia Gandhi. There can be no doubt that as in the coloured and failed revolutions in the former Soviet Republics, external forces are monitoring and mentoring the rise and rise of Ms. Sonia Gandhi, triggering one crisis after another to expose national and societal weakness, and make inroads in critical areas of the polity, economy, and society.

The nation has never been in such acute danger as at present. The US-led West seems determined to aggravate tensions in our part of the world, from a troop surge in Afghanistan to increased strikes in Pakistan, and it is still unclear whether Washington is ultimately going to opt for peace with Teheran, or war.

Either way, the West needs a compliant India. Moreover, Britain seems determined to carve out an independent Kashmir, and it will suit London to have the Gandhi family at the helm if this is to be executed. After all, Ms. Sonia Gandhi met Mr. Rajiv Gandhi in London, and Mr. Rahul Gandhi agreed to give Foreign Secretary David Miliband a conducted tour of India’s rural poverty despite his execrable remarks about Kashmir being the core issue between India and Pakistan.

Mr. Advani will have to decide if he wants to fight and win, or play second fiddle to the Kuru-Gandhis. The abiding lesson of the Mahabharata is that victory belongs to the one who shoots the eye of the fish – not to those who skirt around the tail.

In one of the worst Maoist attacks on security forces in Maharashtra, 15 policemen including a sub-inspector were killed in the jungles of Markegaon village in Dhanora tehsil of Gadchiroli district, around 300 km from Nagpur, on Sunday morning. No casualties were reported among the Maoists.

According to police sources, around 40 Maoists of the newly-formed Border-Platoon Dalam were involved in the ambush. Markegaon is close to the Gyrapatti-Sawargaon road and Gyrapatti police assistance centre, which is along the Maharashtra-Chhattisgarh border.

The police sub-inspector killed has been identified as Bhupendra Gudgekar of Amravati. A number of cops took bullet injuries. A sources in Gadchiroli police said, ''The police party was heading towards Markegaon, some 45 km from Dhanora, to investigate into the January 30 arson committed by the Maoists, when the rebels attacked them. The police party was ambushed in such a manner that all the members, including head PSI Gudgekar, were killed on spot.''

The ambush took place at around 11.15 am. When a relief party reached the area to rescue the first team, it, too, was attacked, preventing immediate reinforcement. But by late Sunday afternoon, more than 3,000 police personnel were sent to Gadchiroli. The ambush itself was triggered after nearly 40 Maoists of Tippagarh Dalam torched a road-roller and a tractor pressed for building a bridge near Markegaon village on Sawargaon-Kotgul road, on January 30. The police party had left to investigate the arson attack and was heading for the spot for further investigation when they were ambushed in the dense forest. Condemning the attack, Maharashtra minister of state for home Nitin Raut said, ''Not satisfied with killing the cops, the Maoists also placed explosives on the bodies of dead cops. They also took away the weapons.''

He admitted that Maharashtra Anti-Naxal Operations helicopter was not flight worthy for the past few months. But another helicopter from Nagpur flew to Dhanora for rescue operation. The bodies of the cops were airlifted to Gadchiroli by Sunday evening.

Gadchiroli is considered a punishment posting for obvious reasons. Cops admit that mortality rate is quite low here. If Naxals don't target you, the mines planted them will.

With all establishments closed for the day, as a mark of respect the policemen, Chavan and some of his cabinet colleagues were assured of a good audience. He landed at about 3 pm by a helicopter from Nagpur. Chopper, did one say? The Anti-Naxal Organisation has been fighting for a chopper to help in combing and fighting operations in the forests. One landed last year but could not take off. Now, the only blades they see are the ones on the fan in their dormitories. And, yes, Chavan did say that Rs 330 crore has been spent on fighting Naxalism in the last year and another Rs 1300 crore has been earmarked for the next three years.

Had the money been spent to armour the state cops better, Chavan wouldn't have been in Gadchiroli on Monday.

Some 26/11 heroes were decorated with Padma awards. 01/02 cops deserve nothing short of the Bharat Ratna, commented a face in olive green.

Oh, this news reporter will be in trouble with communal pseudo-secular Congress et al for referencing the place by its original name Dandakaranya, as mentioned in Hindu Holy scripture Ramayam during God Shri Ram ji's time during Treta Yug.
The police have learnt that a formidable team was brought on one platform by the rebels under Diwakar, recently promoted as member of Dandakaranya special zonal committee, for the attack. Apparently, the attack was carried out with the support of a number of nearby villages and resulted in an entire short range patrol party of Gadchiroli police being wiped out.

Leftist Corruption: CPM's Rs 374.50 crore SCN-Lavalin scam

SNC Lavalin scandal
SNC-Lavalin power scandal is one of the biggest financial scams that rocked Kerala, India. The Comptroller and Auditor General of India report indicted a CPI(M)-led government of the mid-1990s for a Rs 374.50 crore loss to the exchequer. Pinarayi Vijayan has been figured in the 9th accused by charge sheet filed by the CBI. Later, the CBI moved to seek Government's consent to prosecute him.

Three hydel power stations had to be upgraded, tenders were invited and was finalised to an Indian consortium and a Canadian MNC. The foreign company quoted Rs 2.42 crore per MW, the Indian consortium – BHEL and L&T – sought Rs 1.25 per MW. The contract went to the higher bidder, contrary to normal practice.

The Kerala State Electricity Board (KSEB) signed an MoU with SNC-Lavalin in August 1995. Under the provisions of the MoU, the funds for the renovation were to be arranged by SNC Lavalin from the Export Development Corporation (EDC), Canada, and the Canadian International Development Agency (CIDA). The Board did so, ignoring the CEA's recommendation that immediate replacement of the generating units at the Pallivasal power station was not called for as the plant was in fairly good condition. The Board undertook a feasibility study on the proposal only in September 1995, by a retired Chief Engineer of the KSEB, who later became a consultant to Lavalin.

Based on the consultant's report and further discussions, the Board signed contracts with Lavalin to provide technical services for management, engineering, procurement and construction supervision in February 1996, to ensure completion of the projects within three years. The consultancy agreements were converted into fixed price contracts for supply of machinery and techincial services as part of the renovation at a cost of 67.94M Canadian dollars (Rs.169.03 crores) in February 1997. During this period Pinarai Vijayan was the Minister for Electricity.

The CAG has found that Lavalin was only a consultant intermediary and not the original equipment manufacturer and that the supply of goods and services was made by other firms at much higher cost leading to excess expenditure. According to the CAG, the absence of due professional care in negotiating the foreign loan proved to be detrimental to the financial interests of the Board. The Board also could not ensure quality of renovation work in the absence of technology transfer and training of its engineers. Owing to various technical defects in the equipment, the generation of power could not be maintained even at the pre-renovation level and the Board had to spend on repairs.

According to the CAG, failure to exclude fee for technical consultancy from fixed price contracts resulted in avoidable payment of Rs.20.31 crores, and failure to negotiate and exclude the exposure fee from the loan agreement resulted in avoidable payment of Rs.9.48 crores and future liability of Rs.2.21 crores. In the opinion of the CAG, there was also an avoidable payment of Rs.1.20 crores as commitment fee despite there being committed but unavailed advance.

The CAG found that the Government did not receive Rs.89.32 crores out of the grant of Rs.98.30 crores that was promised for the Malabar Cancer Centre.

On 16th January 2007, Kerala High Court ordered a CBI enquiry into the scandal.

On February 19, 2008, CBI informed High court of Kerala that the investigation was progressing and said that former Electricity Ministers Pinarayi Vijayan and G. Karthikeyan would be examined at the appropriate time.

On 21st January 2009, CBI filed a progress report on the investigation in the Kerala high court. Pinarayi Vijayan has been named as the 9th accused in the case.
Lavalin scam: When power and politics collide
The scandal had its genesis in a 1996 agreement that the then Congress-led UDF Government got its Kerala State Electricity Board (KSEB) to sign with a Canadian power consulting company, SNC Lavalin. The contract was for replacing and modernising three major hydroelectric projects at Pallivasal, Sengulam and Panniar.

Soon after, Pinarayi Vijayan joined the Left Cabinet of E K Nayanar as power minister. Vijayan personally led the renegotiation of the earlier contract the KSEB had signed with Lavalin and subsequently went with Nayanar to Canada to seal the new deal. The new contract involved the state Government agreeing to cough up an additional Rs 149.15 crore to Lavalin for buying equipment from suppliers it named — Lavalin itself manufactured no such equipment.

The Comptroller and Auditor General (CAG) of India has found that the expenditure incurred on the renovation of the Pallivasal, Sengulam and Panniar hydroelectric projects, with the involvement of the Canadian firm SNC Lavalin and spending Rs.374.50 crores, had not yielded commensurate gains.

The CAG report on the commercial activities of the State Government for the year ended March 31, 2005, tabled in the Assembly on Monday, says the Kerala State Electricity Board (KSEB) had undertaken renovation and modernisation of the three projects without conducting any feasibility study, disregarding the objections of the Central Electricity Authority (CEA) and without the prior concurrence of the CEA for incurring capital expenditure.

CPM’s cultivated ‘holier than thou’ image was blown to smithereens on Wednesday when the CBI implicated polit bureau member and
Kerala unit secretary Pinarayi Vijayan in the multi-crore SNC Lavalin case. The CPM, which goes off the collective rocker and demand resignations when rival politicians are confronted with similar situations, was silent on the action it proposes against the powerful party leader.

The CBI, which filed a progress report on the investigations in the case in the Kerala high court, has named Mr Vijayan, who was the state’s power minister, as the ninth accused in the case. The CBI has sought the governor’s permission to file a chargesheet that accuses Mr Vijayan and 10 others, including some officials, of receiving kickbacks for allotting a contract to the Canadian firm in 1997.

The Comptroller and Auditor General of India had found irregularities in the contract with SNC Lavalin of Canada for renovation and modernisation of the Pallivassal, Chengulam and Panniyar hydro-electric projects in Idukki district. Mr Vijayan had played the lead role in reworking the deal signed between KSEB and SNC Lavalin.

He had led a high-level official team to Montreal to revise the Lavalin contract. The consultancy contract was expanded to include a supply contract for procuring equipment. While the consultancy fee remained unaltered, the government committed an additional Rs 149.15 crore for buying equipment.

The Kerala government team had also negotiated a sub-deal with the company. Lavalin committed itself to mobilise Rs.98.3 crore for a party controlled cancer hospital in north Kerala. But the company paid only Rs 9 crore to the hospital.

CAG reported that the entire Rs 374.50 crore spent on the renewal projects went down the drain as the company did not complete the renewal process. Officials say that while replaced equipment have become unserviceable, not an extra megawatt of power is being generated from the three hydroelectric projects.

a frame up by the CBI at the behest of the Congress. But facts of the multi-crore SNC Lavalin scandal just do not substantiate this charge.

Here is the sequence of events:

China's growing Military presence and Border Infrastructure

While the Congress led UPA is sleeping after partying hard even after 40 major terrorist attacks under it and its allegedly 3 times college dropout heir apparent is busy giving personal tours of Bharat's poverty to his firangi friends, China has build up mass military presence and border infrastructure in Chinese Occupied Kashmir (CoK) or known as Line of Actual Control (LAK). China has made a whopping 40000 km road network and we are struggling to get clearance from Government to make mere 608 km stretch of road.

China way ahead on border infrastructure
First, India woke up to China's massive buildup of military infrastructure all along the Line of Actual Control (LAC) rather late in the day. And now, it's floundering to execute its own relatively modest plans to strategically counter the Chinese moves.

It was in early-2006 that the UPA government was jolted out of its slumber to give the go-ahead for the creation of infrastructure in all the three sectors — western (Ladakh), middle (Uttarakhand, Himachal) and eastern (Sikkim, Arunachal) — along the unresolved 4,056-km LAC with China.

But progress of the road construction and telecommunication links has been tardy, to say the least, since then. Only nine of the 73 roads earmarked for construction along the Sino-Indian border have been built till now, top-level sources said.

Of the 73 all-weather roads, 27 fall in Arunachal Pradesh, 19 in Uttarakhand, 14 in Jammu & Kashmir, seven in Himachal Pradesh and six in Sikkim. While 27 of these roads are being constructed under the aegis of the home ministry, 15 are with Border Roads Organisation (BRO). The remaining 12 are to be constructed by CPWD or state PWDs.

"The plan is to construct the 73 roads in a time-bound manner by 2012 to counter the rapid pace of military development in the Tibetan Autonomous Region (TAR). But there are huge delays due to pending mandatory clearances from the ministry of environment and forests as well as inadequate funding," said a source. While acknowledging environmental and geological concerns are important, the defence establishment holds national security concerns are equally, if not more, critical. "Suitable interventions and faster decision-making is required," added the source.

BRO, in particular, has been directed to complete construction of the roads stretching from Ladakh to Diphu La in Arunachal, amounting to 608-km at a cost of Rs 992 crore, by 2010 or so.

The infrastructure development is important to bolster India's troop mobility and logistics supply in the forward areas, especially since some existing roads simply stop dead 60 to 80 km from LAC.

"While Chinese soldiers can drive right till the border in their vehicles due to their superb roads, our soldiers have to sometimes trek 10-15 km to reach their border posts," said a senior official.

China, on its part, has built so many air, road and rail links along the LAC, especially in TAR, that it can amass a huge number of troops on the border for offensive operations in double-quick time compared to what was possible less than a decade ago.

China now has a 40,000-km road network in Tibet, apart from rail links like the 1,118-km one from Lhasa to Gormo in Qinghai province of mainland China.

The Xenitis story turns even more curious if one takes a look at the gullibility of banks which queued up to fund the promoters. The company had shown secured and unsecured loans at Rs 173 crore and Rs 31.17 crore respectively as on September 30, 2007, as mentioned on page 10 of the Draft Red Herring Prospectus (DRHP).

This is besides the cash credit enjoyed in excess of Rs 200 crore from a consortium of 11 banks, led by UCO Bank, as listed in the DRHP (page 15) and other banks like Development Credit Bank, Shakespeare Sarani branch, Axis Bank etc. The company borrows from one bank to pay another and every year it has to show healthy increase in top line to get higher loans and higher cash credit limits from banks so that the previous liabilities to them can be met by new borrowings. This is blatant abuse of public money.

But siphoning off this money, borrowed from banks, was not the sole purpose of inflating the business volumes. A news item on April 16, 2008, in The Economic Times, Kolkata edition, shows how Santanu Ghosh, the Xenitis owner, sold 5 per cent of his personal stakes in the company to SBI for Rs 25 crore and that another 20 per cent would be offloaded this year. Thus, within this year, Ghosh aims to earn Rs 125 crore by off-loading his personal stakes in the company.

Evidently all the window-dressing was not merely to borrow from banks to run the business, but to create a platform for selling the business itself to earn riches for the promoter. Earning personal riches of Rs 125 crore in five years from the profits of a legitimate business is a Herculean task. By window-dressing the books and logging in huge fake turnover, Ghosh did better to entice institutions into buying his personal stakes in the business.

Global Automobiles (P) Ltd, another arm of this company, has also been indicted for such fraudulent booking of turnover. But the company is using its proximity to the political bosses in West Bengal to sit pretty over the show-cause notices issued to it by the directorate.

Teesta Setalvad/CPI(M) bribed riot witnesses before trial, threatened others

While the Vishwa Hindu Parishad of America (VHPA), Inc. (World Hindu Council of America) cleared its stand on the alleged response by Sonal Shah to the unfounded accusations which were part of the Anti-Hindu communal propaganda by Evangelic-Leftist groups in the US. The truth about known Anti-Hindu bigot Teesta Setalvad was exposed a few days ago by the victims of the riots that happened in Gujarat after the terrorist attack in Godhra by Muslims. 58 Hindus (including 20 children, 15 women, and 23 men) were burnt alive using 140 liters by Muslim Terrorists as proved by the Nanavati-Mehta Commission report made public recently. And then happened despicable violence in its aftermath. As per the figures given by the Union Minister of State for Home Prakash Jaiswal, who belongs to the Congress Party, in Parliament on May 11 2005, 790 Muslims and 254 Hindus were killed in the riots, 2548 people were injured and 223 people were missing.

The revelation a few days ago was that a host of Gujarat riot case victims were misled into signing affidavits giving false information at the behest of Citizens for Justice and Peace (CJP), an NGO headed by Teesta Setalvad. Teesta Setalvad willfully fabricated and submitted incorrect information to Courts.

Daily Pioneer has brought out another revelation about Teesta who is one of the many fanatic Pseudo-Secular fundamentalist out there who don't believe in Majority Rights. Apparently, Teesta's Gujarat-based NGO processed payment from CPM relief fund to pay the witnesses just before the trial.
A controversial Gujarat-based NGO was instrumental in organising payment of Rs 1 lakh each to as many as ten witnesses in various post-Godhra riot cases. The money came from the CPI(M) relief fund and was distributed months before the witnesses deposed in the courts, five years after the clashes took place. Four other eyewitnesses received Rs 50,000 each.

The revelation comes in the backdrop of reports that a host of Gujarat riot case victims were misled into signing affidavits giving false information at the behest of Citizens for Justice and Peace (CJP), an NGO headed by social activist Teesta Setalvad.

Incidentally, those who were both victims and eyewitnesses received Rs 1 lakh and Rs 50,000 while the victims got mere Rs 5,000 each. This has raised eyebrows over the selection of beneficiaries and the purpose of paying a disproportionately large sum to the eyewitnesses before the trial.

Chief Coordinator of CJP Rais Khan told The Pioneer that he had submitted the name of beneficiaries to the CPI(M) on instruction from Teesta Setalvad. “Setalvad identified the people and I merely followed her instruction and forwarded the list to CPI (M),” Khan said.

When contacted, Setalvad said she was present at the function on an invitation from the CPI(M) and had nothing to do with fund raising. “It was CPI(M) money and I was a mere guest at the function,” she claimed.

Yasin Naimudin Ansari, one of the eyewitnesses who got one lakh rupees, told The Pioneer on phone from Ahmedabad that he was approached by someone from Teesta Setalvad's organisation. "I vaguely remember this. But I don't remember the name of the person," he said.

The function took place in Ahmedabad on August 26, 2007 and the witnesses were handed out demand drafts by CPI(M) politburo member Brinda Karat, Teesta Setalvad and Rais Khan.

The Pioneer is in possession of letters written by beneficiaries thanking Brinda, Teesta and Rais Khan for the payment.

Yasmin Banu Ismailbhai Shaikh (aunt of Zahira) of Baroda, who received Rs 50,000 (DD No 567552 dated August 1, 2007). Yasmin is a complainant in case No. 114/04 at Baroda. It is interesting to note that, when no substance was found in her complaint, she was directed to face lie detection test by the court and ever since she has not appeared in the court.

Among the recipients are four Best Bakery case witnesses and nine are appearing as witnesses in Ahmedabad-related Naroda Patia, Shahpur, Khanpur and other 2002 riot cases.

The information has been gleaned through a string of petitions under the Right to Information Act by one H Jhaveri from various agencies, including banks.

As a consequence of the above revelations, Teesta Setalvad's former confidant Raees Khan has filed a FIR against her for threatening him.
"I have filed an FIR (First Information Report) against Teesta today at Rakhial police station. She is behind the threatening calls that I am receiving for the past couple of days," said Raees Khan, a former confidant and once the coordinator here for Citizens for Justice and Peace (CJP).

Khan said late on Friday evening that he had to take this step as calls were made to him from Ahmedabad railway station warning him and his family of dire consequence if "I turn out to be a nuisance to Teesta".

"Do not say anything about Teesta. Do not address the media. Keep strictly away from media persons. Even if one word is spoken against Teesta, you and your family will have to pay a heavy price," Khan quoted the caller as saying.

"Today my application was accepted by the Rakhial police inspector and also an FIR was filed. I also met the assistant commissioner police and told him the reason behind my seeking police protection," Khan said.

In his complaint, Raees Khan has directly accused Teesta. "If I am attacked or if anything happens to my family, I will hold Teesta personally responsible," Khan said in the FIR, adding that though he had no enmity with Teesta, she was hounding and threatening him.

"'I will send you to a place from where you will not return', Teesta had warned me recently when I asked for my two months' salary dues," Khan said.

Raees Khan is in the eye of the storm after he was accused of distorting facts in affidavits of the six Naroda Gam witnesses viz., Madina Pathan, Maqsoon Pathan, Rafiq Sheikh, Mohammed Malik, Rafiq Malik and Rahim Malik when he filed their affidavits in 2003.

These witnesses have deposed before the Supreme Court-appointed Special Investigation Team (SIT) that they did not know about the content of affidavits filed before the Supreme Court.

"I did my duties diligently at the office located at Shahpur and all went well until 2007 when she unceremoniously sacked me. She was at her abusive best when she showed me the door," Khan said.

"I have not been paid my two months' salary. The computer and the fax machine and other stationery items belonged to me as I had purchased with my own money and have receipts to prove it. Yet she has taken all of it, claiming that it belonged to her. When I demanded that my property be returned, she said she would fix me in such a way that I will be rotting behind bars for the rest of the life," Khan told IANS.

He also alleges that yet, when he went ahead undeterred and demanded his dues he was approached by people close to Teesta who advised him not to tangle with Teesta.

"'She is too powerful and she can harm you irreparably. It is better you keep away from her', they had advised me," Khan said.
